Application by Landowner
A landowner may apply to:
- include land in the ALR
- exclude land from the ALR
- subdivide land in the ALR
- use land in the ALR for non-farm purposes
(If a non-farm proposal involves placement of fill or the removal of soil, see Notice of Intent and Application for Non-farm Use to Place Fill or Remove Soil.)
The Applicant
- Completes the Application by Landowner form.
- Completes the notice of application requirements if applying to exclude land.
- Submits the application, fee and proof of notice (if applying to exclude land) to the local government.

The Local Government
- Checks the application for completeness.
- In certain instances, must authorize the application to proceed (see Sec. 25 (3) and 30 (4) of the ALCA).
If authorization is not granted, the application ends and a portion of the fee ($300) is returned to the applicant.
- Completes a Local Government Report form and makes comments and recommendations.
- Forwards all documents to the Commission.
The Commission
- Sends a letter to the applicant which acknowledges receipt, assigns and application number, identified the staff person handling the application and estimates the approximate time for a decision.
(A copy of the letter is sent to the local government.)
- Prepares a Summary Report and forwards a copy to the applicant.
- Holds a meeting for applications for exclusion to allow the applicants an opportunity to present their proposals.
- May hold a meeting for applications involving inclusions, subdivision or non-farm use.
- May view the property under application.
- May refer the application to various agencies if further information is required.
- Makes a decision on the application.
- Notifies the applicant in writing of the decision.
(A copy of the letter is sent to the local government.)
NOTE: As outlined in the above process, it is the Commission that makes the decision on an application.
However, the Agricultural Land Commission Act provides that the Commission may enter into an agreement with a local government which gives the local government the authority to make decisions on applications of subdivision or use of land within the ALR.
Where such an agreement exists, the local government is the decision-maker and the Commission has no role in the process.
